The personal data protection officer is, in accordance with Article 2, paragraph 1, point 9. of the Act on the Protection of Personal Data (Official Gazette 103/03, 118/06, 41/08, 130/11 and 106/12 - consolidated text, hereinafter (the Act), the person appointed by the head of the collection of personal data who takes care of the legality of personal data processing and of the process established to enable the patients to exercise their right to personal data protection.
The duties of the personal data protection officer are prescribed in Article 18a. paragraph 8 of the Act, according to which the personal data protection officer:
- takes care of the legality of the processing of personal data in the sense of compliance with the provisions of this Act and other regulations governing issues of personal data processing,
- warns the manager of the collection of personal data on the necessity of applying regulations on the protection of personal data in cases of planning and actions that may have an impact on issues of privacy and protection of personal data,
- informs all persons employed in the processing of personal data of their legal obligations for the purpose of personal data protection,
- takes care of the fulfillment of obligations from Articles 14 and 17. of the Act,
- enables the exercise of the rights of interested parties as set forth within Articles 19 and 20 of the Act,
- cooperates with the Agency for the Protection of Personal Data in connection with the implementation of supervision over the processing of personal data.
The personal data protection officer is obliged to maintain the confidentiality of all information and data he learns in the performance of his duties. This obligation continues even after the termination of the duties of the personal data protection officer.
